The Trump Administration Seeks High Court Clearance for National Guard Personnel in Illinois

On the last weekday, the White House submitted an urgent appeal to the federal top court, seeking approval to station military reserve forces to Illinois.

This move is part of a larger push to expand the internal deployment of the armed forces in several urban centers under Democratic control.

Court Fight Over Troop Deployment

In an urgent petition, the US Department of Justice urged the court to set aside a previous judicial decision that had blocked the deployment of several hundred military reserve personnel to the greater Chicago.

The federal judge had expressed skepticism about the government's explanation for activating the guard, challenging its explanation in given local conditions.

A appellate court affirmed the lower court’s decision on Thursday, leaving the deployment on hold while the court case proceeds.

White House's Claims

The top government lawyer, representing the administration, claimed in the new filing that federal agents have repeatedly been “threatened and attacked” in the city of Chicago and the neighboring town of Broadview area.

This area is home to an Immigration and Customs Enforcement holding center.

The president has already dispatched national guard forces to Chicago and Portland, Oregon, subsequent to earlier activations to Los Angeles, the city of Memphis, and the nation's capital.

The White House has claimed that troop deployment is necessary to control demonstrations and bolster border control.

Political Opposition

Elected Democrats have strongly opposed the move, arguing that the White House's statements are overstated and driven by politics.

They charge the administration of exploiting his executive power to target political rivals.

Judges have also raised questions about the administration’s depiction of events.

Local leaders claim that demonstrations over deportation policies have been mostly modest and calm, contrasting with the president’s characterization of “battlefield” conditions.

At the center of the legal battle is the administration's application of a federal statute allowing the president to take control of the military reserve only in cases of rebellion or when “unable with the federal troops to carry out the laws of the US”.

In recent weeks, the government nationalized three hundred personnel of the state guard of Illinois and commanded more Texas national guard personnel into the region.
